Do you need planning permission for a conservatory?

For most homeowners, a conservatory doesn’t need planning permission since it falls under what’s known as permitted development. It usually comes down to three things: how far the structure projects, how tall it stands and how close it sits to your property boundary.

Building first and checking later has become a riskier habit, now that councils have far longer to act on unapproved work. The old four-year enforcement window grew to ten years in April 2024. A decision made without checking can follow a property for a long time, resolving this later is far more disruptive than confirming planning permission first.

The same rules apply for planning permission nationwide

Permitted development is set by national planning law, not your local council, so the same size and height limits apply wherever you live in England. Your own property’s planning history can still make a difference, so it’s worth checking the Planning Portal if previous extensions have already been added.

How big can a conservatory be without planning permission?

For a conservatory built onto the rear of the house, the standard figures are:

  • Rear extension: up to four metres on a detached house, or three metres on a semi-detached or terraced property
  • Overall height: no more than four metres
  • Eaves height (where the roof meets the top of the wall): three metres or less, if the conservatory sits within two metres of a boundary
  • Side extensions: limited to half the width of the original house
  • Roof pitch: should generally match the existing house, with nothing built forward of the front wall

Need more room than the standard limits allow? The larger home extension scheme could still help. It works through a process called prior approval, which lets you build rear extensions up to eight metres on a detached house, or six metres on other property types, well beyond the usual rules.

There’s a catch: your local planning authority has to notify your neighbours first, under the neighbour consultation scheme, before confirming you can go ahead. Push past these bigger limits, and you’re firmly into full planning permission territory.

Does a conservatory need building regulations approval?

Most conservatories are exempt from building regulations, as long as they’re built at ground level, measure under 30 square metres and are separated from the house by proper external doors or windows. They’ll also need their own independent heating system, rather than sharing the house’s boiler and controls.

When you will need planning permission

There are a few common scenarios where permitted development won’t cover you, and it’s worth knowing them before you start planning. Full planning permission is likely to be needed in any of these cases:

  • Listed buildings, where listed building consent is required regardless of the conservatory’s size
  • Homes within a conservation area which covers parts of Aylesbury town centre, Walton and Wendover Road locally
  • Houses that have already reached their permitted development allowance through earlier extensions
  • Plans to convert the space into self-contained living accommodation further down the line, such as an annexe

If you’re unsure whether any of the above applies to your home, checking with your local council before finalising your design will give you peace of mind before work starts.

Getting your planning permission status in writing

Even where a conservatory doesn’t need planning permission, many homeowners choose to confirm this formally. It’s called a lawful development certificate. This isn’t a legal requirement, but it creates a paper trail that can matter later, especially if a future buyer’s solicitor raises questions during a sale.
